***SPECIAL COVID-19 NOTICE – March 23, 2020***

Notice is hereby given that at the direction of the United States Trustee, all pending 341(a) meetings of creditors have been continued to a later date to be determined. This order may be extended.

The continuance of the creditor meetings does not relieve debtors of their obligation to commence making plan payments to the Trustee not later than 30 days after the date the petition was filed. See 11 U.S.C. 1326(a)(1). In addition, Local Bankruptcy Rule 3015-1 and the Bankruptcy Code require that debtors submit proof of all sources of income, the most recent years’ tax return, evidence of post-petition mortgage payments and other important documents to the Trustee not later than 7 days prior to the date set for the initial 341(a) meeting of creditors. Failure to comply with these requirements may result in dismissal of the case.
Debtors should submit their initial (and subsequent) plan payment(s) via TFS (www.tfsbillpay.com). Debtors may also make payment(s), in the form of certified check or money order, payable to “Chapter 13 Trustee” and mailed to P. O. Box 1330, Riverside, CA 92502 (be sure to print your last name and case number on the instrument). Remember that payment comes due each month.

All documents that have not been filed with the court and which are required to be submitted to the Trustee should be uploaded to the Trustee’s secure portal, available at www.13 documents.com.

 

CONFIRMATION AND MISCELLANEOUS HEARING. Chapter 13 confirmation hearings and hearings on miscellaneous chapter 13 matters will be held as scheduled. Check www.cacb.uscourts.gov for each judge’s instructions for appearances.


TRUSTEE'S MOTION TO DISMISS
. Debtors should submit delinquent funds timely, so that they are received and posted by the Trustee prior to the date of the hearing. If funds are to be submitted close to the hearing date, debtor should tender those funds to his or her attorney, so that the attorney can represent to the Trustee and/or the Court that the attorney is holding those funds. Debtors and their attorneys will not be able to submit funds to the Trustee at the hearings.
